MN Swap Meet Terms of Use

These Terms of Use ("Terms") govern your use of the MN Swap Meet app (the "app"), operated by MN Swap LLC, a Minnesota limited liability company ("we," "us"). By creating an account, subscribing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

What the app is

MN Swap Meet is an online marketplace that helps buyers and sellers find each other at powersports swap meets and online. Shoppers can browse listings and message vendors for free. Vendors pay for a subscription to register a booth and post listings.

Buying and selling is between users

We provide the platform only. We are not a party to any sale between a buyer and a seller, and we do not own, inspect, or guarantee any item listed. We do not process payments for items sold through the app. Buyers and sellers arrange payment, pickup, and shipping themselves. You are responsible for evaluating items, confirming descriptions and condition, and following any laws that apply to your transaction. We are not responsible for the quality, safety, legality, or accuracy of any listing, or for the conduct of any user.

Accounts

You may browse the app without an account. To message vendors or sell, you may need to sign in with email, Apple, or Google. You are responsible for your account and for keeping your sign-in details secure, and you agree that the information you provide is accurate. You must be at least 13 years old to use the app.

Vendor subscription

Vendor access is an auto-renewing annual subscription sold through the Apple App Store or Google Play. The price is shown in the app before you subscribe. Introductory prices and any free trial offers may change or end at any time, and the price shown at purchase applies to that purchase.

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• The subscription renews automatically each year unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID or Google Play account settings. Deleting the app does not cancel your subscription.
• Billing and refunds are handled by Apple or Google under their policies. We cannot issue refunds for purchases made through their stores.

If you purchase through the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies to your use of the app.

Community rules

You agree not to post or send content that is vulgar, offensive, harassing, threatening, fraudulent, or illegal. You agree not to list stolen property or items you do not have the right to sell, not to impersonate others, not to harass other users, and not to misuse the app or interfere with its operation. Listings must be accurate and relate to powersports parts, machines, or related items.

We may remove listings, messages, or content, and may suspend or end accounts, at our discretion if we believe these Terms are being violated. If your access is ended for a violation, you will not be entitled to a refund. To report a listing or user, email events@mnswapllc.com.

Your content

You keep ownership of the listings, photos, and messages you post. By posting them, you give us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content in connection with operating the app. You promise that you have the right to post it. Listings expire automatically after 90 days unless renewed.

Our rights

The app, including its name, logo, and design, belongs to MN Swap LLC and is protected by law. We grant you a limited, personal, non-transferable license to use the app as permitted by these Terms. You may not copy, modify, reverse engineer, or resell the app.

Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not promise the app will always be available, uninterrupted, or error free.

Limitation of liability

To the fullest extent permitted by law, MN Swap LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from transactions between users, including lost or damaged items, payment disputes, or personal injury. Our total liability to you for any claim related to the app is limited to the amount you paid us for your subscription in the 12 months before the claim. Some places do not allow certain limits, so parts of this section may not apply to you.

Ending your use

You may stop using the app at any time. We may suspend or end your access if you violate these Terms or if we stop operating the app. Sections that by their nature should continue, such as ownership, disclaimers, and limits of liability, will continue after your access ends.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Continued use of the app after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in Minnesota, unless the law where you live requires otherwise.
